The steps in order
This page is general information, not legal advice. Rules, taxes and fees differ by property and buyer and change over time, so confirm every step with your lawyer and bank.
- 1. Offer and booking: agree the price and pay a booking deposit against a written offer. Check how long the offer is valid and what happens to the deposit if either side withdraws.
- 2. Appoint a lawyer: the lawyer prepares the sale and purchase agreement and checks the title. Ask who pays which legal fees.
- 3. Sale and purchase agreement (SPA): both sides sign and the buyer pays the agreed deposit. The SPA sets the completion period and what happens if either side is late.
- 4. Loan: if you borrow, the bank issues a letter of offer, then its lawyer prepares the loan documents and the charge over the property. Apply early; approval takes time.
- 5. Consent: some transfers need the State Authority's consent, for example for foreign buyers or certain land types. The lawyer applies for it.
- 6. Stamping: the SPA and the transfer document are stamped (stamp duty paid) where required.
- 7. Completion: the balance is paid (from you and the bank) and the seller settles any existing loan on the property.
- 8. Transfer of title: the transfer is registered at the land office so the title is in your name (and the bank's charge is registered if you have a loan).
- 9. Vacant possession: you receive the keys and check the unit against the agreement. Settle utility accounts and, for a condominium, the management account.
Frequently asked questions
Do I need a lawyer to buy a property in Johor Bahru?
Yes. A lawyer prepares the agreement, checks the title, deals with stamping and the transfer, and acts for you if a problem comes up.
How long does it take to complete a purchase?
The SPA sets the completion period, often around a few months. Loan approval and any consent can affect the timing, so ask your lawyer for a realistic timeline.
Who pays the legal fees?
It depends on the agreement and the type of fee. Agree this in writing before you pay a deposit.
Sources and method
Figures come from the property listings published on benfooproperty.com on 7 November 2026, refreshed daily. They are asking prices and asking rents set by owners, not sale prices, and medians are used so a few very high or low prices do not distort the result. Loan examples use the stated assumptions and are not a bank offer. Written and reviewed by Ben Foo, registered estate negotiator (REN 33376), PropNex Realty Sdn.
